Welcome to Pointly Earn. These Terms of Service ("Terms") govern your access to and use of the Pointly Earn mobile application and related services (collectively, the "Services"). By downloading, accessing, or using Pointly Earn, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
You must be at least 13 years of age to use Pointly Earn. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the Services. By using Pointly Earn, you represent and warrant that you meet the applicable eligibility requirements.
Certain features, offers, surveys, or reward opportunities may have additional age or geographic restrictions. We reserve the right to verify eligibility at any time and to suspend or terminate accounts that do not meet these requirements.
To access certain features of Pointly Earn, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Pointly Earn is not liable for any loss or damage arising from unauthorized access to your account.
You may not register for more than one Pointly Earn account. Creating multiple accounts, whether directly or through the use of automated means, is strictly prohibited and may result in termination of all associated accounts and forfeiture of any accumulated rewards.
Pointly Earn allows you to earn points or credits ("Rewards") by completing tasks, surveys, offers, watching videos, installing applications, and participating in other activities made available through the Services.
The availability of tasks, offers, surveys, and other earning opportunities depends on various factors, including your geographic location, device type, and demographic profile. Pointly Earn does not guarantee the availability of any particular earning opportunity or minimum earning amount.
Reward values for each task or offer are displayed within the application and are subject to change at any time without prior notice. We reserve the right to adjust reward values, modify earning opportunities, or discontinue any feature at our discretion.
Rewards are credited only after successful verification of task completion. Verification may be performed by Pointly Earn or its third-party partners. We reserve the right to withhold or reverse rewards if we determine, in our sole discretion, that a task was not completed in accordance with the applicable requirements.
Rewards may be redeemed for gift cards, PayPal transfers, cryptocurrency, or other payout options available through the Services. The specific redemption options available to you depend on your location and account standing.
Pointly Earn may impose minimum redemption thresholds, daily or monthly limits, and other restrictions on reward redemption. These limits are subject to change.
Redemption requests are typically processed within the timeframe indicated in the application. However, processing times may vary depending on the redemption method, verification requirements, and external factors. Pointly Earn is not responsible for delays caused by third-party payment providers.
We reserve the right to cancel, revoke, or withhold rewards in cases of fraud, abuse, violation of these Terms, or technical errors. Rewards have no cash value outside of the redemption options provided through the Services and are not transferable.

Violation of these prohibitions may result in immediate suspension or termination of your account, forfeiture of all accumulated rewards, and legal action where appropriate.
All content, features, and functionality of Pointly Earn, including but not limited to the application design, text, graphics, logos, icons, and software, are owned by or licensed to Pointly Earn and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use Pointly Earn for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
Pointly Earn may contain links to, integrate with, or display content from third-party websites, applications, and services. These third-party services are governed by their own terms and privacy policies. Pointly Earn does not endorse, control, or assume responsibility for any third-party content, products, or services.
Your interactions with third-party offer providers, survey platforms, advertisers, and payment processors are solely between you and the third party. Any disputes or issues arising from such interactions must be resolved directly with the relevant third party.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POINTLY EARN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POINTLY EARN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
In no event shall Pointly Earn's total liability to you for all claims arising under these Terms exceed the amount of rewards you have redeemed through the Services in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
The limitations of liability in this section shall apply regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise, even if Pointly Earn has been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Pointly Earn and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
We reserve the right to suspend or terminate your access to Pointly Earn at any time, with or without cause, and with or without prior notice. Grounds for termination may include, but are not limited to, violation of these Terms, suspected fraudulent activity, extended inactivity, or any conduct that we believe may harm Pointly Earn or other users.
Upon termination, your right to use the Services will immediately cease. Any accumulated rewards that have not been redeemed may be forfeited at our discretion, subject to applicable law. You may also discontinue use of the Services and delete your account at any time.
Provisions that by their nature should survive termination, including but not limited to intellectual property, disclaimer of warranties, limitation of liability, and indemnification, shall survive termination.
We may update these Terms from time to time to reflect changes in our Services, business practices, legal obligations, or for other operational reasons. When we make changes, we will update the "Effective Date" at the top of these Terms and make the revised Terms available through the application.
Material changes may be communicated through in-app notifications, email, or other reasonable means. Your continued use of Pointly Earn after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must discontinue use of the Services.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pointly Earn operates, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the applicable rules of the chosen arbitration forum, unless otherwise required by applicable law.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action, class arbitration, or other representative proceeding to the fullest extent permitted by applicable law.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pointly Earn regarding your use of the Services and supersede any prior agreements or understandings, whether written or oral.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be made in writing and signed by an authorized representative of Pointly Earn.
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Pointly Earn may assign or transfer these Terms, in whole or in part, without restriction.
